These Terms & Conditions (“Terms”) govern access to and use of the Loomy website and apply to all purchases made through the Loomy online store.

By accessing or using the website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the website or place orders.

3. Eligibility

By using the website or placing an order, you confirm that you have legal capacity to enter into binding contracts under Georgian law, including:

  • you are acting with the consent of a parent or legal guardian.

4. Products & Product Information

  • Loomy offers children’s clothing and related products primarily through its online store.
  • Product descriptions, images, sizing information, and prices are provided for reference purposes.
  • Minor variations in color or appearance may occur due to screen settings or manufacturing differences.
  • Loomy reserves the right to modify, replace, or discontinue products at any time without prior notice.

5. Prices & Currency

  • All prices are displayed in Georgian Lari (GEL).
  • Prices include applicable Georgian taxes unless explicitly stated otherwise.
  • Delivery costs, customs duties, or import taxes (for international orders) are not included unless shown at checkout.
  • In the event of a pricing error, Loomy reserves the right to cancel the order and issue a full refund.

6. Orders & Contract Formation

  • An order is considered placed once payment has been successfully completed.
  • Order confirmation by email does not constitute final acceptance.
  • A legally binding sales contract is concluded once the order is dispatched.

Loomy reserves the right to refuse or cancel orders in cases of:

  • payment failure or verification issues;
  • suspected fraud;
  • incorrect product or pricing information;
  • stock unavailability.

If payment has already been made, a full refund will be issued.

7. Payments

  • Payments are processed through secure third-party payment providers.
  • Loomy does not store full payment card details.
  • Available payment methods are displayed during checkout.
  • All transactions may be subject to anti-fraud and compliance checks.

8. Shipping & Delivery

Loomy does not operate its own delivery service.

All deliveries are carried out by independent third-party courier and logistics providers selected at checkout.

  • Available delivery methods, shipping costs, and estimated delivery times are displayed during checkout.
  • Delivery timeframes are estimates only and are not guaranteed.
  • Loomy is not responsible for delays, loss, or damage caused by third-party delivery services after the order has been handed over to the courier, unless otherwise required by applicable law.
  • The risk of loss or damage passes to the customer once the order is transferred to the courier service, unless otherwise required by applicable law.

Any delivery-related claims after dispatch must be addressed directly with the relevant courier service, unless otherwise required by applicable law.

9. Defective Products & Warranty

If a product is defective, damaged upon delivery, or does not correspond to the description, the customer must notify Loomy within a reasonable time after receipt.

Loomy’s obligations regarding defective products are governed by applicable consumer protection laws of Georgia and may include repair, replacement, or refund, depending on the circumstances.

This section does not limit any mandatory consumer rights under applicable law.

10. Returns & Refunds

In accordance with Georgian legislation and international e-commerce standards:

  • Customers may return eligible items within 14 calendar days of receiving the order.

Returned items must be:

  • unused and unwashed;
  • in original condition;
  • with original tags and packaging.
  • Certain items (including hygiene-sensitive products (including underwear), promotional items, , customized items) may be non-returnable unless required by law.

Refunds

  • Approved refunds are processed to the original payment method.
  • If the customer has expressly chosen a delivery method that is more expensive than the standard delivery option offered by Loomy, the additional cost resulting from such choice shall not be refunded.
  • The customer shall be liable for any reduction in the value of the goods only where such reduction results from handling of the goods beyond what is necessary to establish their nature, characteristics, and functioning.
  • Refund processing times depend on the payment provider.

11. Promotions, Discount Codes & Gift Cards

  • Promotional codes, discount offers, and gift cards are subject to specific conditions communicated at the time of issue.
  • Discount codes must be applied at checkout and cannot be applied retroactively.
  • Promotions may be limited in time, quantity, or scope and may not be combined unless explicitly stated.
  • Gift cards and promotional discounts are not redeemable for cash unless required by law.

12. Order Cancellation

  • Orders may be canceled before shipment by contacting customer support.
  • Once an order has been shipped, cancellation is no longer possible and return rules apply.


13. Offline Location

Loomy primarily operates as an online store.

The company may maintain a physical location in Tbilisi for administrative, operational, showroom, or brand-related purposes.

All purchases made through the website are considered online transactions and are governed exclusively by these Terms & Conditions.

The physical location:

  • does not guarantee the availability of all products listed online;
  • is not required to process in-person sales;
  • does not automatically accept returns or refunds for online orders unless explicitly agreed in writing.

Return, refund, and cancellation rules for online purchases apply regardless of the existence of a physical location.

14. Intellectual Property

All content on the website, including text, images, product designs, logos, and branding elements, is the intellectual property of Kids Mamas and Papas LLC (Loomy) and may not be copied, reproduced, or used without prior written consent.

15. Third-Party Links

The website may contain links to third-party websites or services.

Loomy is not responsible for the content, terms, or privacy practices of such third parties and provides these links for convenience only.

16. User Obligations

Users agree not to:

  • provide false, misleading, or incomplete information;

  • violate applicable laws or third-party rights.

Loomy reserves the right to restrict or terminate access for violations.

17. Limitation of Liability

To the maximum extent permitted by law:

  • Loomy shall not be liable for indirect, incidental, or consequential damages;
  • Loomy’s total liability is limited to the amount paid for the relevant order, except where mandatory consumer protection laws provide otherwise.

Loomy shall not be liable for actions, omissions, delays, or failures of third-party delivery, payment, or service providers beyond Loomy’s reasonable control.

Nothing in these Terms limits liability where such limitation is prohibited by law.

18. Force Majeure

Loomy shall not be liable for any delay or failure to perform its obligations if such delay or failure results from events beyond its reasonable control, including but not limited to natural disasters, war, strikes, epidemics, governmental actions, interruptions of internet or communication services, or other force majeure events.

19. Privacy & Data Protection

Personal data is processed in accordance with:

  • the legislation of Georgia;
  • applicable international standards, including GDPR where relevant.

20. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Georgia.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Georgia.

21. Amendments

Loomy reserves the right to amend these Terms at any time.

Updated Terms become effective upon publication on the website.
